01 General Provisions & Updates الأحكام العامة والتحديثات

1.1. These Terms apply to both Drivers and Passengers.1.1. تنطبق هذه الشروط على السائقين والركاب.

1.2. By registering for an account or using the Services, you give your full consent to comply with this Agreement. If you disagree with any provision, you must stop using the Services immediately.1.2. بتسجيلك حسابًا أو استخدامك للخدمات، فإنك تُقرّ بموافقتك التامة على الالتزام بهذه الاتفاقية. في حال عدم موافقتك على أيٍّ من بنودها، يجب عليك التوقف عن استخدام الخدمات فورًا.

1.3. Modifications: Darp (the “Administrator”) may amend or supplement this Agreement, the policies, or any supplemental terms at any time. Changes take effect upon posting in the app or site. Continued use constitutes acceptance.1.3. التعديلات: Darp ("المسؤول") يجوز لهم تعديل أو استكمال هذه الاتفاقية، أو السياسات، أو أي شروط إضافية في أي وقت. تسري التغييرات فور نشرها في التطبيق أو الموقع. ويُعد الاستمرار في الاستخدام موافقةً.

1.4. Supplemental Terms: Certain features (e.g., promotions, events, or specific products) may be subject to additional terms disclosed to you. Those terms supplement—and, if there is a conflict, supersede—this Agreement for the relevant feature.1.4. الشروط التكميلية: قد تخضع بعض الميزات (مثل العروض الترويجية، والفعاليات، أو منتجات محددة) لشروط إضافية يتم الإفصاح عنها لك. تُكمّل هذه الشروط هذه الاتفاقية، وفي حال وجود تعارض، تُلغيها بالنسبة للميزة المعنية.

1.5. Definitions:1.5. التعاريف:

• Administrator: Darp, a company established under the laws of the United Arab Emirates (UAE).المسؤول: Darp ، شركة تأسست بموجب قوانين دولة الإمارات العربية المتحدة.
• Mobile App: the Darp app for iOS and Android.تطبيق الهاتف المحمول أو الجوال: تطبيق Darp لنظامي التشغيل iOS وAndroid.
• Passenger: a legally capable individual at least 18 years old who requests transportation through the Mobile App.الراكب: شخص مؤهل قانونيًا يبلغ من العمر 18 عامًا على الأقل ويطلب النقل من خلال تطبيق الهاتف المحمول.
• Driver: a legally capable individual at least 18 years old who provides transportation through the Mobile App as an independent contractor.السائق: فرد مؤهل قانونيًا يبلغ من العمر 18 عامًا على الأقل ويوفر النقل من خلال تطبيق الهاتف المحمول كمتعاقد مستقل.
• User: collectively refers to both Drivers and Passengers.المستخدم: يشير بشكل جماعي إلى السائقين والركاب.
• Personal Data: information relating to an identified or identifiable individual.البيانات الشخصية: المعلومات المتعلقة بشخص محدد أو يمكن تحديده.
• Content: information, data, text, audio, video, images, or other materials posted, uploaded, or otherwise provided through the Services.المحتوى: المعلومات أو البيانات أو النصوص أو الصوت أو الفيديو أو الصور أو المواد الأخرى المنشورة أو المحمّلة أو المقدمة بطريقة أخرى من خلال الخدمات.

02 Nature of the Services طبيعة الخدمات

2.1. Technology Platform: Darp provides a platform that enables Passengers to arrange and schedule rides with independent Drivers. Darp does not itself provide transportation and is not a common carrier or employer of Drivers.2.1. منصة التكنولوجيا: Darp توفر منصة تُمكّن الركاب من ترتيب وجدولة رحلاتهم مع سائقين مستقلين. Darp لا تُقدم خدمات النقل بنفسها، وليست شركة نقل عام أو جهة توظيف للسائقين.

2.2. Safety Model: Darp is designed exclusively for passengers and drivers. Accounts may be verified for compliance.2.2. نموذج الأمان: تم تصميم Darp حصرياً للركاب والسائقين. وتخضع الحسابات للتحقق لضمان الامتثال والمعايير.

2.3. Availability: Features and Services may vary by country, region, or city and may be modified, suspended, or discontinued at any time.2.3. التوفر: قد تختلف الميزات والخدمات حسب البلد أو المنطقة أو المدينة، وقد يتم تعديلها أو تعليقها أو إيقافها في أي وقت.

2.4. ThirdParty Services: The Services may integrate with thirdparty services (e.g., maps, payments). Darp is not responsible for thirdparty services or content.2.4. خدمات الطرف الثالث: قد تتكامل الخدمات مع خدمات جهات خارجية (مثل الخرائط والمدفوعات). Darp غير مسؤولة عن خدمات أو محتوى الجهات الخارجية.

03 License & Acceptable Use ترخيص الاستخدام المقبول

3.1. Limited License: Darp grants Users a limited, nonexclusive, nontransferable, nonsublicensable, revocable license to use the Mobile App for its intended purpose.3.1. رخصة محدودة: تمنح Darp للمستخدمين ترخيصًا محدودًا وغير حصري وغير قابل للتحويل وغير قابل للترخيص وقابل للإلغاء لاستخدام تطبيق الهاتف المحمول للغرض المقصود منه.

3.2. Restrictions: Users may not misuse the Services (including reverse engineering, scraping, or unlawful conduct).3.2. القيود: لا يجوز للمستخدمين إساءة استخدام الخدمات (بما في ذلك الهندسة العكسية، أو استخراج البيانات، أو السلوك غير القانوني).

3.3. App Store Beneficiaries: Apple and Google are thirdparty beneficiaries with respect to storespecific versions of the Mobile App.3.3. المستفيدون من متجر التطبيقات: تُعد Apple وGoogle من الجهات الخارجية المستفيدة فيما يتعلق بالإصدارات المخصصة للمتجر من تطبيق الهاتف المحمول.

04 Accounts Eligibility & Conduct سلوك وأهلية الحسابات

4.1. Registration: Both Passengers and Drivers must create an Account with accurate, current information. Drivers may be required to provide a license, insurance, and vehicle details.4.1. التسجيل: يجب على كلٍّ من الركاب والسائقين إنشاء حساب بمعلومات دقيقة وحديثة. قد يُطلب من السائقين تقديم بيانات رخصة القيادة والتأمين وتفاصيل المركبة.

4.2. Security: Users are responsible for all activity on their Account and must keep credentials secure.4.2. الحماية: المستخدمون مسؤولون عن جميع الأنشطة التي تتم على حساباتهم ويجب عليهم الحفاظ على بيانات الاعتماد آمنة.

4.3. Single Account: Multiple accounts are prohibited unless authorized.4.3. حساب واحد: يُحظر إنشاء حسابات متعددة إلا بعد الحصول على ترخيص.

4.4. Women-Only Model: Where applicable, accounts must comply with the dedicated women-only model and requirements.4.4. تطبيق النموذج للنساء فقط: يجب أن تتوافق الحسابات مع النموذج المخصص للنساء فقط عند تفعيله.

4.5. Conduct: Passengers must behave respectfully; Drivers must operate vehicles safely and legally. Harassment, discrimination, unsafe acts, or illegal activity are prohibited.4.5. السلوك: على الركاب التحلي بالاحترام، وعلى السائقين قيادة المركبات بأمان وقانونية. يُحظر التحرش، والتمييز، والأعمال غير الآمنة، والأنشطة غير القانونية.

4.6. Messaging: By creating an Account, you consent to receive servicerelated communications.4.6. الرسائل: من خلال إنشاء حساب، فإنك توافق على تلقي الاتصالات المتعلقة بالخدمة.

4.7. Promotions: Promo codes or credits are subject to specific conditions and may be revoked.4.7. العروض الترويجية: تخضع أكواد الترويج أو الاعتمادات لشروط محددة ويمكن إلغاؤها.

4.8. Inactive Accounts: Inactive accounts may be deleted after a set period of time.4.8. الحسابات غير النشطة: من الممكن حذف الحسابات غير النشطة بعد فترة زمنية محددة.

05 User Generated Content المحتوى الذي ينشئه المستخدم

5.1. Ownership: Users retain ownership of submitted content but grant Darp a license to use it for service operation and promotion.5.1. الملكية: يحتفظ المستخدمون بملكية المحتوى المرسل ولكن يمنحون Darp ترخيصًا لاستخدامه لتشغيل الخدمة والترويج لها.

5.2. Responsibility: Users warrant that the submitted content does not infringe rights or laws.5.2. المسؤولية: يضمن المستخدمون أن المحتوى المقدم لا ينتهك الحقوق أو القوانين.

5.3. Monitoring: Darp may remove content that violates policies.5.3. المراقبة: قد تقوم Darp بإزالة المحتوى الذي ينتهك السياسات.

06 Devices & Network الأجهزة والشبكة

6.1. User Responsibility: Users are responsible for maintaining compatible devices, data plans, and Internet access. Darp does not guarantee compatibility or uninterrupted service.6.1. مسؤولية المستخدم: يتحمل المستخدمون مسؤولية الحفاظ على توافق الأجهزة، وباقات البيانات، وخدمة الإنترنت. لا تضمن Darp التوافق أو استمرارية الخدمة.

07 Payments & Fees المدفوعات والرسوم

7.1. Passenger Charges: Passengers agree to pay fares, fees, and taxes shown in the Mobile App. Darp acts as the Driver’s limited payment collection agent.7.1. رسوم الركاب: يوافق الركاب على دفع الأجرة والرسوم والضرائب الموضحة في تطبيق الهاتف المحمول. تتولى Darp مسؤولية تحصيل المدفوعات المحدودة للسائق.

7.2. Driver Payments: Drivers receive payment through the app net of Darp’s commission, fees, and adjustments.7.2. مدفوعات السائقين: يتلقى السائقون الدفع من خلال شبكة التطبيق الخاصة بعمولات Darp والرسوم والتعديلات.

7.3. Refunds: Except as required by law, payments are final and nonrefundable.7.3. المبالغ المستردة: باستثناء ما يقتضيه القانون، تكون المدفوعات نهائية وغير قابلة للاسترداد.

7.4. Dynamic Pricing: Prices may vary during peak demand.7.4. التسعير الديناميكي: قد تختلف الأسعار خلال وقت الذروة.

7.5. Cancellations: Passengers may be charged fees for late cancellations or noshows; Drivers may be penalized for repeated cancellations.7.5. الإلغاءات: قد يتم فرض رسوم على الركاب في حالة الإلغاء المتأخر أو عدم الحضور؛ وقد يتم فرض عقوبات على السائقين في حالة الإلغاء المتكرر.

7.6. Repair & Cleaning Fees: Passengers may be charged for damage/cleaning; Drivers may be charged for negligence causing passenger loss or safety issues.7.6. رسوم الإصلاح والتنظيف: قد يتم فرض رسوم على الركاب مقابل الأضرار/التنظيف؛ وقد يتم فرض رسوم على السائقين مقابل الإهمال الذي يتسبب في خسارة الركاب أو مشاكل السلامة.

08 Insurance & Safety التأمين والسلامة

8.1. Driver Insurance: Drivers must maintain all licenses and insurance required by law.8.1. تأمين السائق: يجب على السائقين الاحتفاظ بجميع التراخيص والتأمينات المطلوبة بموجب القانون.

8.2. Safety Tools: Inapp tools (e.g., SOS, live tracking) are for convenience and do not replace emergency services.8.2. أدوات السلامة: إن الأدوات الموجودة داخل التطبيق (على سبيل المثال SOS، والتتبع المباشر) مخصصة للراحة ولا تحل محل خدمات الطوارئ.

8.3. Prohibited Conduct: Violence, harassment, intoxication, unsafe driving, or carriage of illegal items is prohibited.8.3. السلوك المحظور: يُحظر العنف، أو التحرش، أو التعاطي، أو القيادة غير الآمنة، أو حمل المواد غير القانونية.

09 Intellectual Property الملكية الفكرية

9.1. Ownership: The Services and related IP remain the property of Darp or licensors.9.1. الملكية: تظل الخدمات والملكية الفكرية ذات الصلة ملكًا لشركة Darp أو المرخصين لها.

9.2. Trademarks: Users may not use Darp trademarks or branding without consent.9.2. العلامات التجارية: لا يجوز للمستخدمين استخدام العلامات التجارية أو العلامات التجارية الخاصة بـ Darp دون موافقة.

10 Disclaimers, Liability & Indemnity إخلاء المسؤولية والتعويض

10.1. As-Is Basis: Services are provided without warranties.10.1. أساس كما هو: يتم تقديم الخدمات بدون ضمانات.

10.2. ThirdParty Responsibility: Darp is not responsible for thirdparty acts, including Driver performance.10.2. مسؤولية الطرف الثالث: لا تتحمل شركة Darp مسؤولية تصرفات الطرف الثالث، بما في ذلك أداء السائق.

10.3. Indemnity: Users agree to indemnify Darp against claims arising from their use or misconduct.10.3. التعويض: يتفق المستخدمون على تعويض Darp ضد المطالبات الناشئة عن استخدامهم أو سوء سلوكهم.

11 Suspension & Termination التعليق والإنهاء

11.1. Cause for Action: Darp may suspend or terminate accounts for violations, fraud, unsafe conduct, or noncompliance.11.1. أسباب الإجراء: يحق لشركة Darp تعليق أو إنهاء الحسابات في حالة حدوث انتهاكات أو احتيال أو سلوك غير آمن أو عدم امتثال.

11.2. Voluntary Deletion: Users may delete their accounts at any time, subject to settlement of dues.11.2. الحذف الاختياري: يحق للمستخدمين حذف حساباتهم في أي وقت، مع مراعاة تسوية المستحقات.

11.3. Survival: Relevant obligations (payments, liability limits, indemnities) survive termination.11.3. سريان الالتزامات: الالتزامات ذات الصلة (المدفوعات، وحدود المسؤولية، والتعويضات) تبقى سارية بعد انتهاء العقد.

12 General Provisions الأحكام العامة

12.1. Notices: Provided through app, email, or mail.12.1. الإشعارات: يتم تقديمها من خلال التطبيق أو البريد الإلكتروني أو البريد.

12.2. Assignment: Users may not transfer rights without consent. Darp may assign this Agreement.12.2. التنازل: لا يجوز للمستخدمين نقل الحقوق دون موافقة. يحق لـ Darp التنازل عن هذه الاتفاقية.

12.3. Relationship: No employment, agency, or partnership is created between Darp and Users.12.3. العلاقة: لا يتم إنشاء أي عمل أو وكالة أو شراكة بين Darp والمستخدمين.

12.4. Severability: Invalid terms do not affect the enforceability of the remainder.12.4. قابلية الفصل: لا تؤثر الشروط غير الصالحة على قابلية تنفيذ بقية البنود.

12.5. Entire Agreement: This Agreement, plus incorporated policies, forms the entire contract.12.5. الاتفاقية كاملة: تشكل هذه الاتفاقية، بالإضافة إلى السياسات المضمنة، العقد بأكمله.

12.6. Changes: Darp may update terms anytime; continued use is acceptance.12.6. التغييرات: قد تقوم Darp بتحديث الشروط في أي وقت؛ الاستمرار في الاستخدام يعد قبولاً.
